These terms govern your use of the FashClick mobile app, published by VrittIQ. By creating an account or using the app, you agree to be bound by them. If you don't agree, please don't use FashClick.
These terms cover the FashClick app only. Use of the VrittIQ website is covered by our main Terms and Conditions.
1. Definitions
- "VrittIQ", "we", "us", "our" — refers to the VrittIQ business operating from 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, UK.
- "FashClick", "the App" — refers to our virtual try-on application for iOS and Android.
- "You" — refers to any user of the App.
- "Try-on image" — refers to an image generated by the App from the photos you upload.
2. The Service
FashClick lets you upload a photo of a person and a photo of a garment, and uses artificial intelligence to generate an image showing how that garment might look when worn. Generating an image consumes credits from your plan.
3. Eligibility and Accounts
You must be at least 13 years old to use FashClick. You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate registration information and keep it up to date.
4. Acceptable Use — Images You Upload
This is the most important obligation in these terms. By uploading any image to FashClick, you confirm that:
- The image is of yourself, or you have the explicit permission of every identifiable person shown in it to upload it and to have a try-on image generated from it;
- You own the image or otherwise have the right to use it, and doing so infringes nobody's copyright, trademark, privacy, or publicity rights;
- The image does not depict a child in any sexualised way, and does not contain nudity, sexually explicit material, violence, or unlawful content;
- You will not use FashClick to create images that harass, demean, defame, sexualise, or impersonate any person, or that could mislead anyone into believing a real person wore or endorsed something they did not.
Uploading a photo of another person without their consent is a breach of these terms. We may suspend or permanently terminate your account, without refund, if we believe you have breached this section. If you become aware of content that breaches this section, or of an image of you generated without your consent, email contact@vrittiq.co.uk and we will investigate and act promptly.
5. Licence You Grant Us
To provide the service, you grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and transmit the images you upload — including sending them to our AI image-generation provider — solely to generate the try-on images you request and to deliver them back to you. This licence exists only for that purpose and ends when the images are deleted. We do not use your images to train AI models, and we do not use them for advertising or marketing. 6. Ownership of Generated Images
As between you and us, you retain ownership of the images you upload, and we do not claim ownership of the try-on images generated for you. You may use generated images for your own personal, non-commercial purposes. Note that the legal status of AI-generated images varies between countries and we make no representation that any generated image is protectable by copyright.
7. Nature of AI-Generated Results
Try-on images are AI-generated approximations, not photographs of you wearing the garment. They may be inaccurate or unrealistic, and may misrepresent fit, size, drape, fabric, colour, pattern, or detail. They are not a guarantee of how a garment will look, fit, or be manufactured, and should not be relied on as the sole basis for a purchasing decision. Results vary with image quality, lighting, pose, and garment type. VrittIQ is not the seller of any garment shown and gives no warranty about any product depicted.
8. Credits, Subscriptions, and Payment
FashClick offers a free tier and paid plans that provide credits for generating try-on images. Plan name, duration, credit allowance, and full renewal price are shown in the app before you purchase.
- On iOS, all purchases are made through Apple In-App Purchase. Subscriptions renew automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. Manage or cancel your subscription in your Apple ID settings — we cannot cancel it for you. Refunds are handled by Apple under Apple's own policies.
- On Android, purchases are processed by Stripe, and subscriptions may be cancelled in the app.
- Credits are for use within FashClick, have no cash value, are not transferable or exchangeable, and unused credits do not carry over beyond the terms of your plan.
- Prices may change; we will give notice of changes affecting a renewal before it takes effect.
Nothing in this section affects your statutory rights as a consumer under UK law, including any right to cancel.
9. Availability, Suspension, and Termination
We aim to keep FashClick available but do not guarantee uninterrupted service, and we may modify or discontinue features. You may stop using the App and delete your account at any time from within the App; deletion is subject to the 30-day grace period described in our FashClick Privacy Policy. We may suspend or terminate your access if you breach these terms, if required by law, or if we discontinue the App.
10. Apple App Store Provisions
Where you obtain FashClick from the Apple App Store, you acknowledge that: these terms are between you and VrittIQ only, and not with Apple; Apple has no obligation to provide maintenance or support for the App; Apple is not responsible for any product warranties or for addressing any claim relating to the App, including product liability, legal compliance, or intellectual-property infringement claims; and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You further confirm you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and are not on any US Government restricted-parties list.
11. Intellectual Property
The FashClick app — including its software, design, graphics, logos, and the "FashClick" and "VrittIQ" names — is owned by VrittIQ or licensed to us, and is protected by UK and international copyright and trademark laws. You may not copy, modify, reverse-engineer, or create derivative works from the App except to the extent permitted by law.
12. Disclaimer
The App is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
13. Limitation of Liability
To the maximum extent permitted by law, VrittIQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the App. Our aggregate liability for any claim arising out of the App shall not exceed the greater of £100 or the amount you paid us in the 12 months before the claim, except where liability cannot be limited or excluded by law (such as for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law). Nothing in these terms limits your statutory rights as a consumer.
14. Indemnification
You agree to indemnify and hold VrittIQ harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your breach of these terms — in particular section 4 — or your unlawful use of the App.
15. Changes to These Terms
We may revise these terms from time to time. The "Last updated" date at the top reflects the latest revision. Continued use of the App after changes are posted constitutes acceptance of the revised terms.
16. Governing Law & Jurisdiction
These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident elsewhere in the UK, you may also bring proceedings in your local courts.
